Jarvis SIPP Declaration

I apply to become a member of the Jarvis SIPP and agree to be bound by the rules of the Scheme as set out in the Terms and Conditions which may be amended from time to time.
I have read and understood the Terms and Conditions and Key Features documents that together form the legally binding agreement to open my Jarvis SIPP account.
I understand a trustee is appointed for the Jarvis SIPP and owns the cash and investments within my Jarvis SIPP but holds them for my benefit. I acknowledge that Seccl Custody Limited has been appointed to hold custody of the cash and investments in accordance with the trust deed and rules.
If I do not understand any point within the linked documents and declarations, or have any questions, I will seek professional advice before proceeding.
I authorise:
• Seccl Custody Limited to administer and arrange my investments held within my pension that I may request. I also authorise Seccl Custody Limited to transfer money to and from bank accounts for the purposes of facilitating my pension.
• Any correspondence or documentation to be sent to the message hub in respect of my pension instead of by post, unless legally required to do so.
I confirm that:
• I haven’t received any advice from Jarvis or Seccl Custody Limited under the terms of the Financial Services and Markets Act 2000.
• I have read the Privacy statement contained in the Terms and Conditions Document and give my permission for my personal data to be processed as described in this statement and the General Data Protection Regulations.
• I will tell you in writing within 30 days if:
o There is a change to my name, permanent residential address or residency status;
o I am made bankrupt; or
o There are any changes to the information provided in my application as soon as I am aware that what is stated is no longer true and complete.
Transfer-in Declarations, these apply to any transfers into this pension plan from an existing pension scheme
I authorise, instruct and apply to the current provider or providers to transfer sums and assets from the plan or plans, as listed in my application, directly to the Seccl Personal Pension Plan and to provide any instructions and or discharge required by any relevant third party to do so.
I accept that in order to comply with regulatory obligations, Seccl Custody Limited and the current provider or providers may need to verify my identity and residential address and may use credit reference agency searches and ask for my documents to verify my identity and address.
Until this application is accepted and complete, Seccl Custody Limited’s responsibility is limited to the return of total payment or payments to the current provider or providers.
When payment is made to Seccl Custody Limited as instructed, this means that I shall no longer be entitled to receive pension benefits from the whole of the plan or plans listed where the whole of the plan or plans is transferring, or that part of the plan or plans represented by the payment or payments if only part of the plan or plans is transferring.
I have read the information provided or made available to me by the current provider or providers in connection with the transfer or transfers and have considered if there are any benefits or options I may lose as a result of the transfer or transfers.
I confirm that I have provided only true and accurate information in applying for the transfer or transfers. I understand that Seccl Custody Limited and the current provider or providers cannot accept responsibility, and are not liable, for any losses resulting from untrue, incorrect or misleading information that I provide, or from any failure on my part to comply with any aspect of this application.
I authorise Seccl Custody Limited, the current provider, any contributing Employer and any Financial Adviser named in this application to obtain from each other, and release to each other, any information that may be required to enable the transfer of sums and assets to Seccl Custody Limited.
I accept that the benefits to be provided by the Seccl Personal Pension Plan may be in a different form and of a different amount from those which would have been payable by the current provider, and there is no statutory requirement on the Seccl Personal Pension Plan to provide for any guaranteed benefits to survivors, out of the transfer payment.
I understand that where any benefits being transferred are in capped drawdown they will only be accepted on the basis that they will be immediately converted to flexi-access drawdown. I also understand that if I draw any income via flexi-access drawdown I will become subject to the Money Purchase Annual Allowance, if I am not already subject to it. I hereby instruct that any capped drawdown benefits are converted to flexi-access drawdown upon receipt.
Contribution Declarations
If contributions are to be paid I declare that:
1. I am under age 75 and a relevant UK individual under section 189 of the Finance Act 2004.
2. The total of the client contributions paid to this Scheme and to other registered pension schemes, in respect of which I am entitled to tax relief, under section 188 of Finance Act 2004, will not exceed, in any tax year, the higher of:
o The basic amount in that tax year, currently £3,600 gross; or
o 100% of my relevant UK earnings, as defined in section 189 of Finance Act 2004 in that tax year.
I will give notice to Jarvis if an event occurs, as a result of which I will no longer be entitled to relief on contributions, under section 188 of Finance Act 2004. I will give this notice by the later of:
1. End of the tax year in which the event occurs; and
2. 30 days after the event.
I understand and acknowledge that:
1. If I have Enhanced or Fixed Lifetime Allowance protection this will be lost if a contribution is made to this pension plan or any other pension plan and it is my responsibility if this occurs.
2. I understand that it is my responsibility to inform HMRC through my self-assessment tax return of the pension contributions made to all pension schemes and that contributions in excess of the annual allowance or money purchase annual allowance, MPAA, will normally mean I will be subject to a tax charge at my marginal rate of tax.
3. Once contributions have been received into my pension plan, they can only be refunded in line with HMRC rules or if I cancel my pension plan within the 30 day cancellation period.
I understand that:
• Checks will be carried out to establish proof of my identity and residence, and those of a third party or my employer, where contributions are to be paid by either of them. Should these checks prove unsatisfactory, I will be required to provide proof of identity that is deemed satisfactory before my pension account opening can be accepted.
I declare that, to the best of my knowledge and belief, all the information I have supplied including any other documents completed in relation to my application, and the statements made in this declaration are, to the best of my knowledge and belief, correct, complete and not misleading. Jarvis Pension Finding Terms
These terms apply to your use of the Jarvis Pension Finding Service, as described in more detail in our app, the Services. Please read these terms carefully and in full each time before using the Services. If you do not agree to these terms, you can't use the Services.
The Services are provided by Pension Jar Limited trading as Jarvis.
Jarvis is an appointed representative of P1 Investment Services Limited, which is authorised and regulated by the Financial Conduct Authority under firm reference number 752005.
Using the Services
To use the Services, you must be an individual aged 18 or older, who is or has been employed, self-employed or a worker in the UK.
There is no charge to use the Services.
To start using the Services, you will need to complete the pension finding process in the Jarvis app. We call this a Pension Finding Request. For each Pension Finding Request, you will be asked to provide your full name, date of birth, National Insurance number, current residential address, details of your former employer and or the details of the pension provider.
Please read and check the details of your Pension Finding Request carefully before submitting it. You will be able to correct any errors before submitting your Pension Finding Request. If any of this information is missing, we may not be able to carry out the search but we will let you know where that's the case.
By submitting a Pension Finding Request, you are deemed to have agreed to these terms.
We can only search for your pensions in your name and you can't use the Services on behalf of someone else.
By using the Services, you represent and confirm that:
1. you will not use our Services for any fraudulent, unlawful or abusive purpose;
2. the information you provide, including in your Pension Finding Request, is your own and you are duly authorised to provide such information;
How we provide the Services

We use Raindrop Technologies Holdings Ltd, Raindrop, to help us deliver the Services. Raindrop will only handle your data to the extent needed to assist us in delivering the Services to you and in accordance with applicable data protection laws. Raindrop's privacy policy can be found here.

This means that where we refer to "we" or "us" in these terms, it may indicate Raindrop completing the action on our behalf. However, while parts of the Services you receive are provided to you directly by Raindrop, your contractual relationship when you use the Services is with Jarvis.
Investigating Pension Finding Requests
We will only accept your Pension Finding Request when we email you to confirm this.
We may contact you to say that we do not accept your Pension Finding Request. This is typically for the following reasons:
1. You have not verified your e-mail address after submitting a Pension Finding Request.
2. Where your Pension Finding Request relates to pension arrangements:
i. that are active, meaning still receiving or being credited with regular monetary payments or contributions to it;
ii. relating to public sector employment;
iii. relating to an employment period of 3 months or less;
iv. relating to an employment prior to the year 1990.
If for whatever reason, we cannot otherwise carry out the Services we will let you know.
We'll start looking for your pensions after we email to confirm your Pension Finding Request. We will let you know what we have found but it is important to note that it takes time for pension schemes to respond to requests. We will respond to you promptly when we have received the information from the pension scheme.
If there is any change to the way we hoped to respond to your Pension Finding Request, or if a pension provider or other third party does not respond on the information you have provided us, or if they request further information, we will let you know.
If we find more than one pension with the information given to us in your Pension Finding Request, we will let you know. In addition, we'll let you know if we find pension schemes or arrangements which were not expressly covered in your Pension Finding Request.
If you receive a positive result from your Pension Finding Request and the plan is transferrable based on our parameters, you agree for us to automatically consolidate your pensions with Jarvis.
The Services are concluded when you have been sent the result of the search. If you submit another Pension Finding Request, there will be a new contract between us.
Your Tracing Progress
We will provide you with access to the Jarvis app to track the progress in relation to your Pension Finding Request.
It is your responsibility to keep your credentials used to access the Jarvis app safe and confidential and contact us immediately if this information has been compromised or if someone may have unauthorised access to your app.
By using the app, you are deemed to have accepted the Jarvis terms of use, which are incorporated into these Terms. In the event of any inconsistency between any other aspects of the terms, this Service terms will prevail.
Your personal information
Each time you submit a Pension Finding Request:
1. you provide explicit consent for us, and the select third parties we use to help us provide the Services, to use personal information about you in connection with the provision of the Services to you. This includes sharing your personal information with pension providers and other third parties for the purposes of identifying your pensions; and
2. you provide explicit consent for us to contact you in relation to the results of your Pension Finding Request.

Right to cancel
You have the right to cancel within 14 days of submitting your Pension Finding Request without giving any reason. You can do this by sending an email to jarvis@myraindrop.co.uk stating that you wish to cancel your Pension Finding Request.
Limitation on our liability
Other than as expressly set out in these terms, any additional terms we introduce from time to time, or implied by consumer law, we do not make any particular commitments or promises to you about our Services.
We provide our Services with reasonable care and skill. All Services are provided to you on an "as is" and "as available" basis. To the extent permitted by applicable law, we exclude all warranties.
Except for any legal responsibility that we cannot exclude in law, such as for death or personal injury, we are not legally responsible for any:
1. losses that were not foreseeable to you and us;
2. losses that were not caused by any breach on our part;
3. business losses; or
4. losses to non-consumers.
In the absence of deliberate default or negligence on our part, we will not be legally responsible to you for any loss that you may suffer in connection with the Services.
We're not responsible for any loss or damage, direct or indirect, caused by something beyond our reasonable control. In these circumstances, we will try to start or restart the Services once we can.
Intellectual Property
We or our third-party licensors owns all rights, title and interest, including intellectual property rights, in and to the Services, our app and technology.
Complaints
We will try to resolve any issues with you quickly and efficiently. If you are unhappy with the Services or any other matter, please contact us as soon as possible using the contact details set out below.
We will handle all complaints in accordance with our complaints policy, which we will provide on request or once you notify us of a complaint.

Governing Law
These terms are only available in English. No other languages will apply to these terms.
These terms are governed by English law and the English courts have exclusive jurisdiction to settle any matters arising in connection with these terms, except that if you are resident in Scotland or Northern Ireland you may also bring proceedings in Scotland or Northern Ireland, as applicable.
